ORDER
This petition under Section 482 Cr.P.C. is filed by the petitioners/A1 to A4 seeking to quash the proceedings in Cr.No.127 of 2016 of I Town Police Station, Karimnagar District, registered for the offences punishable under Sections 448, 427, 506, 380 r/w 34 IPC, against them.
2. It is alleged in the complaint that in between 20.03.2016 and 26.03.2016, when the family of the de facto complainant went to pilgrimage, the accused criminally trespassed into the house of the de facto complainant, damaged the house wall and committed theft of power wires etc., worth Rs.1,50,000/-, which were kept for house construction and they also threatened the watchman not to disclose the matter to the police. Based on the complaint, the aforesaid crime was registered against the petitioners/A1 to A4.
3. As per the complaint, there were property disputes between the petitioners and the de facto complainant. Truth or otherwise of the allegations made in the complaint can be ascertained by the investigating agency during the course of investigation. Therefore, this Court is not inclined to interfere with the impugned proceedings. However, the police concerned are directed to complete the investigation without arresting the petitioners/A1 to A4 and file a final report, if any, in accordance with law. The petitioners/A1 to A4 are directed to appear before the investigating agency as and when required and cooperate with the investigating agency.
4. With the above direction, the Criminal Petition is disposed
of. Miscellaneous petitions, if any, pending in this petition shall stand closed.
