HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36214 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India with a prayer to declare the action of the 3rd respondent in interfering with the personal life and liberty of the petitioner by adopting illegal and unlawful methods of securing his signatures on blank white paper as regards alleged undertaking/ agreement for performance of marriage with the 4th respondent, as illegal and arbitrary.

Heard and perused the material available on record. The grievance of the petitioner is that on the complaint made by the 4th respondent and on her instigation, the 3rd respondent is interfering with his personal life and liberty and compelling him to marry the 4th respondent.

The learned Assistant Government Pleader, on instructions, submitted that it is true that they received a complaint from the 4th respondent and the same is entered in G.D., and thereafter, conducted counseling since the issue arising out of a love affair and at no point of time, the police compelled the petitioner to marry the 4th respondent and, informed that if any crime is registered the police will investigate the matter, in accordance with law. Considering the rival contentions, this Court is inclined to pass the following order:

The 3rd respondent is directed not to interfere with the personal liberty and life of the petitioner, without there being any crime pending

against him. In case, any crime is registered against the petitioner on the basis of the complaint of the 4th respondent, the 3rd respondent is directed to complete investigation and file a final report, if any, in accordance with law, without arresting the petitioner and the petitioner is also directed to appear before the investigating officer concerned, as and when required, and cooperate with the investigation. With the above directions, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
