THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5267 OF 2015 ORDER:
This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioners/A.1 and A.2 seeking bail in crime No.45 of 2013 on the file of the G.K.Veedhi Police Station, Visakhapatnam, registered for the offence under Sections 147, 148, 448, 120(B), 307, 506 read with Section 149 IPC and Sections 25 and 27 of the Indian Arms Act. Heard and perused the material available on record. The allegations against the petitioners/A.1 and A.2 are that they themselves formed into an unlawful assembly and came to the house of the complainant and tried to kill him for cooperating with the police for starting a police station at Pedavalasa village.
The learned counsel for the petitioners submits that P.T.Warrants were issued to the petitioners and that the petitioners were produced before the learned Magistrate and were remanded to judicial custody on 18.04.2015. He further submits that in the earlier cases also, the petitioners were arrested and they were granted bail.
Considering the facts and circumstances of the case, the petitioners/A.1 and A.2 shall be enlarged on bail on condition of their executing personal bonds for a sum of Rs.50,000/- (Rupees fifty thousand only) each with two sureties each for the like sum each to the satisfaction of the V Additional Judicial Magistrate of First Class-cum-Special Court for Prohibition and Excise, Visakhapatnam. The petitioners are directed to report to the Station House Officer, Central Crime Station, Visakhapatnam, daily between 10 A.M. and 5 P.M. until further orders.
