HONOURABLE SRI JUSTICE A.V. SESHA SAI CONTEMPT CASE No. 7 OF 2015 ORDER:

This Contempt Case is filed under Sections 10 to 12 of the Contempt of Courts Act, 1971 complaining of willful disobedience to the orders of this Court dated 27.06.2001 passed in Writ Petition No.1164 of 2001.

Heard learned Counsel for the petitioner and learned Government Pleader appearing for the respondents. This Court by order dated 27.06.2001 disposed of the Writ Petition No. 1164 of 2001 directing the respondents to review the necessity of continuance of the rowdy sheet against the petitioner and take appropriate decision within a period of four weeks from the date of receipt of a copy of the order.

Now after lapse of more than fourteen years, the present Contempt Case is filed.

A counter affidavit is filed by the first respondent herein opposing the present Contempt Case. Apart from the other objections, a preliminary objection is taken by the respondent with regard to maintainability of the Contempt Case on the ground of limitation.

In this connection, it is appropriate to extract the provision of law under Section 20 of the Contempt of Courts Act, 1971, which reads as under:

LIMITATION FOR ACTIONS FOR CONTEMPT:

No Court shall initiate any proceedings of contempt, either on its own motion or otherwise, after the expiry of a period of one year from the date on which the contempt is alleged to have been committed."

In view of the above provision of law, at this length of time, this Court is not inclined to entertain the present Contempt Case.

For the aforesaid reasons, the Contempt Case is dismissed and the respondents are discharged. Miscellaneous petitions pending consideration if any in the Contempt Case shall stand closed in consequence. ---------------------------------- JUSTICE A.V. SESHA SAI Dated 20th March, 2015.
