THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.4656 OF 2014 ORDER:

The petitioners seek writ of Mandamus declaring the inaction of respondents 1 to 3 in taking appropriate action on their petitions, dated 23.01.2014, 27.01.2014 and 03.02.2014, as arbitrary and illegal and contrary to the guidelines issued in G.O.Ms.No.7, dated 16.03.2013 and consequently, direct respondents 1 to 3 to prevent the 5th respondent in proceeding with digging fish pond in his land to an extent of Ac.1.00 cents in Survey No.233/2, which is adjacent to 2nd petitioner's land, without obtaining permission, and pass other orders which are deemed fit.

Heard learned counsel for the petitioners, learned Government Pleader for Revenue, who takes notice on behalf of respondents 1 to 4 and Sri B.Naganjaneyulu, learned counsel for the 5th respondent.

When the matter is taken up for hearing, learned counsel for the 5th respondent, on instructions, would submit that the fish pond, which was dug in his land was already demolished and therefore, no further orders are required in the instant case. 4.

Learned counsel for the petitioners requests the Court to close the writ petition in terms of the submissions made by the learned counsel for the 5th respondent.

Having regard to the above submissions, the Writ Petition is closed giving liberty to the petitioners to raise the issue depending upon its exigencies.
