THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.23504 of 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the inaction of the third respondent in investigating crime No.165 of 2017, as illegal and arbitrary.
Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Home. With their consent, the Writ Petition is disposed of at the stage of admission itself. The limited grievance of the petitioner in this Writ Petition is that though crime No.165 of 2017 of Siricilla Police Station was registered on 07.04.2017 for the offences punishable under Sections 3 (1) (r) (s) of The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, the respondents-Police have not completed the investigation till date.
Learned counsel for the petitioner contends that under the provisions of the said Act, the investigation has to be completed within a period of thirty from the date of registration of FIR. Learned AGP submits that in view of pendency of crimes in the Police Station and as less number of investigating officers are attached to the concerned Police Station, there is a delay and hence seeks reasonable time for completion of the investigation. The counsel for the petitioner agrees for the same. Having regard to the above, the Writ Petition is disposed of directing the respondents-Police to complete investigation and file a final report in crime No.165 of 2017 of Siricilla Police Station, as early
as possible, preferably within a period of three to six months from the date of receipt of a copy of this order.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
