THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.802 OF 2016

O R D E R

This writ petition was filed assailing the proceedings dated 04.01.2016 issued by the Commissioner of School Education, Andhra Pradesh, Hyderabad, which read to the effect that the children and teachers in the State of Andhra Pradesh were required to contribute a sum of Rs.10/- per head towards "MY CAPITAL, MY AMARAVATHI, MY BRICK" campaign. However it is now stated by the learned Advocate General for the State that the proceedings dated 04.01.2016 have been modified by subsequent proceedings dated 05.01.2016 issued by the Commissioner of School Education, Andhra Pradesh, Hyderabad. A copy of the later proceedings is placed on record and it reads as under: "In partial modification of the instructions in the reference 2nd read above, all the District Educational Officers in the State are instructed to collect Rs.10/- (Rupees Ten only) from each teacher and student, who is willing to contribute under "MY CAPITAL, MY AMARAVATHI, MY BRICK" campaign.

Further, all the Regional Joint Directors of School Education and the District Educational Officers in the State are requested to update the same on daily basis.

This should be treated as MOST URGENT."

In the light of the aforestated development, there is no longer an element of compulsion weighing upon the teachers and students to make a contribution as it is now wholly voluntary. That being so, the challenge to the proceedings dated 04.01.2016 no longer survives for consideration.

The writ petition is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed in the light of this final order. No order as to costs.
