THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.22812 of 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the action of respondents 2 to 4 in not taking any action against R-5 in connection with FIR No.31 of 2017 of Mallial Police Station, Jagtial District, registered on 21.03.2017 for the offences punishable under Section 323 IPC and Section 3 (1) (s) of SCs & STs (POA) Act, as illegal and arbitrary, and also to add Section 3 (2) (va) of the said Act. Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Home for respondentsPolice. With their consent, the Writ Petition is disposed of at the stage of admission itself. Since this Court is not going into the merits of the case, there is no necessity to issue notice to R-5.

Though various grounds are raised in the writ petition, at the time of arguments, the learned counsel for the petitioner restricts his prayer, seeking a direction to the respondents-Police to complete investigation and file final report, at the earliest. He further contends that though under the provisions of SCs & STs (POA) Act, the investigation has to be completed within a period of thirty from the date of registration of FIR, but till date no final report is filed. Having regard to the above, the Writ Petition is disposed of directing the respondents-Police to complete investigation and file a final report in crime No.31 of 2017 of Mallial Police Station, Jagtial District, as early as possible, preferably within a period of two months from today. The learned AGP shall inform the concerned Police about the order passed by this Court.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
