HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.6463 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader for the Civil Supplies (AP).

2. This writ petition is filed seeking Writ of Mandamus declaring the action of the respondents in not permitting the petitioner to run the F.P. Shop bearing No.22 of Chendurthi Village, Gollaprolu Mandal, East Godavari District, even though the petitioner's authorization is subsisting, as illegal and arbitrary and for a consequential direction to the respondents to allow the petitioner to run the Fair Price shop.

3. The petitioner is the permanent Fair Price Shop dealer and as he fell sick in the year 2013, he applied for leave. During the said leave period, the fair price shop was entrusted to nearby fair price shop dealer. The grievance of the petitioner is that after recovering from the illness, the petitioner made a representation to the 2nd RespondentRevenue Divisional Officer, Kakinada, and the 3rd respondent-Tahsildar, Gollaprolu Mandal, to permit him to continue as fair price shop dealer and allot the essential commodities for distribution among the cardholders, but so far no action has been taken. Hence, the present writ petition.

Under these circumstances, the 2nd respondent-Revenue Divisional Officer, Kakinada, is directed to dispose of the representation of the petitioner dated 04.12.2014 and 18.12.2014 and pass appropriate orders thereon in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

5. The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No order as to costs.
