This criminal petition is filed for quash of the proceedings in PRC.No.42 of 2011, against the petitioners, who are A1 and A2, on the file of the Judicial First Class Magistrate, Kodangal. The offence alleged is under Section 306 of the Indian Penal Code. 2.

Heard the counsel for the petitioners and the learned Public Prosecutor appearing for the second respondent. None appears for the first respondent.

The learned Public Prosecutor submits that charge sheet has already been filed.

In the light of the above, the criminal petition is dismissed with liberty to the petitioners to file a discharge petition before the Court below raising all contentions as raised in this petition.
