HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 7348 OF 2004 ORDER :

The grievance of the petitioner is that the respondents have not released the increments to which the petitioner is entitled. The petitioner submits that he was initially appointed as Mechanic and after rendering considerable length of service, he was promoted as Depot Manager and retired from service on attaining the age of superannuation on 30.09.2000 and thereafter, the petitioner has submitted representations to the respondents on 5-8-2000 and 8-7-2001, requesting to declare his probation and also to grant increments attached to the post of Depot Manager from 1996, till his retirement i.e., upto 30-9-2000. But the respondents have not considered the said representations and the same are pending with the respondents.

The Standing Counsel, appearing for the respondents contends that since the representations submitted by the petitioner are with the respondents, appropriate orders would be passed on the said representations.

This Court, having considered the rival submissions made by the parties, is of the considered view that this Writ Petition can be disposed of directing the petitioner to submit a fresh representation to

the respondents within a period of two weeks from the date of receipt of a copy of this order and upon such representation being received, the respondents shall consider the same and pass orders in accordance with rules within a period of four weeks thereafter. 4.

The writ petition is accordingly disposed of. 5.
