HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 26219 of 2015 ORDER:

This Writ Petition was filed seeking regularization of the services of non-teaching staff of the third respondent-College. It is the case of the petitioners that they have been working in various capacities since 2009. The third respondent-college has been admitted to grant-in-aid with effect from 01.04.1992 and recognized by the Board of Intermediate Education. It

appears that the second respondent transferred the entire staff including teaching and non teaching staff of the third respondent-college to other colleges leaving only the Principal as the incharge of the college as against G.O.Ms.No.890, dated 02.08.1996. In view of the transfer, the management of the College has employed some staff on temporary basis. The petitioners made a representation on 23.12.2014 to the third respondent-College seeking regularization of their services, which was followed by another representation dated 16.02.2015. This Court by order dated 26.08.2015 directed the respondents to consider the representation dated 23.12.2014 submitted by the petitioners and pass appropriate orders regarding regular pay scales within six weeks from the date of receipt of the said order.

Pursuant to the said direction, the second respondent passed orders vide proceedings Rc.No.Admn.I/9997/2016, dated 18.06.2016 rejecting the case of the petitioner. It was stated in the said proceedings that the petitioners were appointed only in the year 2009 and in view of the same, they have not fulfilled the conditions stipulated in G.O.Ms.No.212, dated 22.4.1994. In view of the same, if the petitioners are aggrieved with the said order, it is left open for them to challenge the same in appropriate proceedings. The Writ Petition is dismissed. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
