THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL APPEAL No.1441 of 2011 JUDGMENT:

This Criminal Appeal, under Section 378(4) of the Code of Criminal Procedure, 1973, is filed by the appellant/complainant, challenging the order, dated 15.06.2011, passed in C.C.No.938 of 2006 by the learned IX Metropolitan Magistrate, Cyberabad, Kukatpally.

Heard the learned counsel for the 1st respondent/accused and the learned Additional Public Prosecutor representing the 2nd respondent/State and perused the record.

Though the appeal is posted under the caption 'for orders', there is no representation for the appellant. In spite of several opportunities, the appellant did not evince any interest to proceed with the matter. Today also, there is no representation for the appellant. It appears that the appellant has no interest to prosecute the appeal.
