HON'BLE SMT JUSTICE ANIS S.A.M.P.No.136 OF 2016 IN/AND SECOND APPEAL No.792 OF 2002 J U D G M E N T:

The appeal is filed aggrieved by the judgment and decree, dated 14.08.2002, in A.S.No.394 of 1998 on the file of XIV Additional Chief Judge, City Civil Court (Fast Track Court), Hyderabad.

Pending the appeal, S.A.M.P.No.136 of 2016 is filed by the petitioner-appellant seeking to record the compromise and dispose of the said appeal in terms of memorandum of compromise, dated 28.12.2015.

Today, at the hearing, the parties and their respective counsel are present in the Court. The appellant and the 1st respondent stated that they have compromised the matter, as per the terms of the memorandum of compromise, dated 28.12.2015. Learned counsel appearing for both the parties submit that the parties have settled the matter outside the Court and filed the memorandum of compromise in the Court in S.A.M.P.No.136 of 2016. The parties and their respective counsel signed the said memorandum of compromise. The terms of compromise are read over and explained to the parties and they have accepted the same as true and correct and binding on them. Accordingly, S.A.M.P. is ordered recording the terms of compromise. Consequently, in view of the terms of compromise entered into by the parties, the Second Appeal is disposed of. The memorandum of compromise shall be made part of the record. A

decree be issued in terms of the memorandum of compromise, which is related to the subject matter of the suit in O.S.No.1421 of 1985 on the file of IV Senior Civil Judge, City Civil Court, Hyderabad.
