HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.7561 of 2002 ORDER:
When the matter is taken up for hearing, learned Counsel appearing for the petitioner as well as learned Standing Counsel for the respondents have submitted that, pursuant to the award passed by the Industrial Tribunal-1, Hyderabad, in I.D.No.55 of 1999 dated 05.10.2001, the petitioner - Singareni Collieries Company Limited has expressed willingness to reinstate respondent No.3 into service without back wages and with continuity of service, and respondent No.3 had agreed for such a proposal.
In view of the above submission and in view of the fact that the petitioner - Singareni Collieries Company Limited was paying 17-B wages to respondent No.3, and in order to give quietus to this issue, the Writ Petition is disposed of directing the petitioner - Singareni Collieries Company Limited to reinstate respondent No.3 into service without back wages but, however, with continuity of service and with all consequential benefits.
Consequently, miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
