HON'BLE SRI JUSTICE P. KESAVA RAO WRIT PETITION No.23265 of 2014 ORDER :
Heard learned counsel for the petitioners as well as the learned Government Pleader for Home appearing for respondent Nos.1 to 4.
The relief sought in the writ petition is as under: "..... this Hon'ble Court may be pleased to issue a direction order or writ more particularly one in the nature of Writ of Mandamus declaring the action of the of the Respondent No.4 in pressurizing the petitioners to compromise with the Respondent Nos.5 and 6, and also in not conducting investigation in pursuance to the registration of FIR.No.26 of 2014 registered under Sections 448, 427, 506 r/w. Section 34 of IPC, as arbitrary, illegal and contrary to the settled principles of law, and consequently, direct the Respondent No.4 to conduct the investigation in pursuance to the registration of FIR.No.26 of 2014 in a fair and transparent manner without pressurizing the petitioners to compromise with the Respondent Nos.5 and 6 and pass such other order ....."
During the course of hearing, learned Government Pleader for Home brought to the notice of this Court that pursuant to the registration of Crime No.26 of 2014 of Jawahar Nagar Police Station, Cyberabad District, for the offences punishable under Sections 448, 427, 506 r/w. Section 34 of IPC, investigation was completed and charge sheet was also filed before the Court concerned. After taking cognizance of the said offences, the same is taken on file as C.C.No.676 of 2014 and the case is pending for trial.
PKR,J W.P.No.23265 of 2014 In that view of the matter, this Court is of the opinion that no further cause would survive in the present writ petition and the same is liable to be closed. Accordingly, this writ petition is closed. No order as to costs.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
