THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.18905 of 2014 ORDER:
Heard learned counsel for the petitioner as well as learned Government Pleader appearing for the respondents 1 to 3. 2.
The prayer sought in the writ petition is as under:- "...to issue writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in interfering in civil disputes and threatening the petitioner to dispossess him from the peaceful possession of his property admeasuring 1500 sft. situated at 22-268, plot No.32, Ground floor, G-2, Bhagyanagar Co-operative Housing Society, Balanagar Mandal, Kukatpally, R.R.District, Hyderabad, as illegal and arbitrary and consequently direct the respondents not to harass the petitioner, his family members and tenants by visiting his premises and pass such other order or orders as this Hon'ble Court may deem fit and proper." 3.
Learned Government Pleader placed on record the written instructions, dated 12.12.2019, issued by the Sub-Inspector of Police, KPHB Police Station, Cyberabad Commissionerate. 4.
From a perusal of the said written instructions, it is revealed that the petitioner herein lodged a complaint with the 3rd respondent against the 4th respondent with regard to the Plot No.32 in Survey No.167 at Bhagyanagar Co-operative Housing Society, Kukatpally Municipality, Balanagar Mandal. Pursuant to the said complaint, a case in Crime No.1287 of 2013 for the offences under Sections 468, 471, 506 and 120-B IPC was registered on 09.12.2013. During the course of investigation, witnesses were examined and their statements were recorded. After completion of investigation, a final report was filed referring the case as 'civil in nature' on 26.08.2014. Except
conducting investigation, the respondent police never interfered with the civil disputes of the petitioner, at any point of time. 5.
In the light of the specific averments made in the written instructions, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be closed. 6.
