THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1151 OF 2016 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/accused seeking bail in NDPS S.C.No.125 of 2015 on the file of the I Additional District and Sessions Judge, Rajahmundry-cum-Special Court for NDPS cases. Heard and perused.

The allegation against the petitioner/accused is that the petitioner was found in illegal possession of 685 kgs of ganja. Learned counsel for the petitioner submits that the petitioner has not committed any offence and that he has been falsely implicated in the case. He prays this Court to grant bail to the petitioner. Considering the fact that the quantity of ganja, which was found in possession of petitioner/accused is commercial quantity, this Court is not inclined to grant bail to the petitioner/accused.
