HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.14623 of 2005 Order: (Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard Mr. T. Lakshminarayana, learned counsel for the petitioner. None appears for the respondents. The petitioner, in the instant writ petition, seeks the following relief:
"For the reasons stated in the accompanying affidavit, the Petitioner prays that the Hon'ble Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the Respondent No.1 granting permission for converting the existing park demarcated and developed as per the approved layout situated at Madhurawada, Visakhapatnam District in Survey No.294/1 into residential plots by the Respondents 2 & 3 in relaxation of layout rules, being illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
This petition appeared before Court last on 17.8.2005, when Rule was issued. No interim order was passed at any point of time.
Thereafter, petitioner never bothered to take this petition before the Court for any purpose whatsoever. Learned counsel for the petitioner is not in a position to state whether the plot of land earmarked as park has been converted into residential plots. In view thereof, we are not inclined to keep this petition pending any further. Hence, the writ petition is dismissed for non-prosecution. Consequently, pending miscellaneous applications shall also stand closed. No costs.
