THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1651 OF 2016 ORDER:

This petition is filed by the petitioner-accused No.11 under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.56 of 2012 on the file of the Judicial First Class Magistrate at Manthani, Karimnagar District.

Heard.

It is alleged that the petitioner and other accused created fake pattadar pass books on the Perapalli Survey numbers and obtained loans by cheating the Government and public. Thus, the petitioner and other accused committed the offence punishable under Sections 468, 471 and 420 IPC.

On reading of the grounds raised by the learned Counsel for the petitioner, this Court is of the view that this is not a fit case to quash the proceedings in the above C.C. The grounds raised by the learned Counsel for the petitioner are to be appreciated by the trial Court. However, taking into consideration the age of the petitioner, his presence before the Court below is dispensed with, except on the dates when his presence is insisted by the Court below. The petitioner shall be represented before the Court below by a Counsel on all hearing dates.

With the above direction, the Criminal Petition is disposed of. Consequently, the Miscellaneous Petitions pending, if any, shall stand closed.
