O R D E R
Petitioner retired from service as Junior Line Man in the respondent - Southern Power Distribution Company of A.P. Limited, on 30.04.2015. The case of the petitioner is that his date of birth is 01.05.1959 and the same was entered in the service register, but the respondents, without any notice to him, altered the same to 01.05.1957. Therefore, in this writ petition, petitioner is seeking for a direction to the respondents, to treat that he retired from service on attaining the age of superannuation on 30.04.2017 instead of 30.04.2015 and consequently to pay full salary and other benefits between the period from 01.05.2015 to 30.04.2017. Heard the learned counsel for the petitioner and Sri N.Siva Reddy, learned Standing Counsel for respondents 1 to 4 and Government Pleader for Energy for respondent No.
6 Admittedly petitioner was issued with retirement notice vide Memo No.DEE/ O/ T1/ GNJ/ JAO/ ADM/ D.No.1656/ 14 dated 05.12.2014 dated 05.12.2014 by the 3rd respondent - Divisional Engineer and he retired from service on 30.04.2015. It is not known why the petitioner has kept quite during the period he was in service, without seeking for change of his death of birth and after retirement, waiting for three years, present writ petition is filed. The Hon'ble Supreme Court time and again held that writ petition claiming for change of date of birth and for consequential reliefs, cannot be entertained at the fag end of service. No reasons are assigned for approaching the court belatedly.
In view of the same, I do not find any reason to entertain the writ petition and the same is accordingly dismissed. Miscellaneous petitions pending, if any, shall stand closed. No costs. ------------------------------------------------- A.RAJASHEKER REDDY,J DATE:27-04-2018 AVS
