The Court made the following: [order follows] O R D E R :
At request for adjournment of writ petition is made on behalf of petitioner. But Sri G. Krishna Murthy, counsel appearing for respondent No.4 submits that the writ prayer relates to the auction notice dated 31/8/2009 and this Court on 12/10/2009 permitted the respondents to conduct the auction but not to confirm the sale for a period of six weeks.
2. According to him, there was no participants in the auction held on 31/8/2009 and it is because of this reason there was no extension of interim order dated 12/10/2009 and for all purposes the writ prayer is rendered infructuous.
4. Sri G.Krishna Murthy further submitted that the account is settled by the borrower and there is no occasion for proceeding further in the matter.
5. Having regard to the above circumstances, I am of the
view, the cause in the writ petition does not survive, the same is dismissed as infructuous. No costs.
6. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
