This application is field under Section 151 of the Code of Civil Procedure seeking permission of this Court to withdraw the writ petition with a liberty to file fresh writ petition.

In the affidavit filed in support of the writ petition it is stated that in view of the pendency of the writ petition the first respondent is not considering the letter addressed by the Joint Collector. It is further stated that as the respondents have agreed to de-notify the portion of the land, the petitioners are not interested in prosecuting the writ petition. It is also stated that in case the respondents fail to de-notify as recommended by the Joint Collector, the petitioners may be permitted to question the said action. 3.

For the aforesaid reasons, application is allowed, permitting the petitioners herein to withdraw the writ petition with a liberty to file fresh writ petition in case the contingency as stated by the writ petitioners arises. 4.

Accordingly, the writ petition is dismissed as withdrawn with the liberty as sought for. As a sequel, the miscellaneous petitions, if any, shall stand disposed of. There shall be no order as to costs. ______________ A.V.SESHA SAI, J Date:19.04.2018 grk
