THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.18289 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ of Mandamus or any other appropriate writ, order or direction, declaring the action of the respondent No.2 Municipality in not taking action on her representation dated 24.3.2017 acknowledged by it on 7.42017 to prevent the respondents 3 and 4 from making illegal construction in Plot No.89/1 of Sy.No.809 to an extent of 200 sq.yards in Kamareddi town until the cases on the file of the Hon'ble High Court in W.P.No.8084/2014 and OS.No.41/2016 on the file of the Senior Civil Judge, Kamareddy are disposed of, as illegal and arbitrary and contrary to the provisions of Municipalities Act and for a consequential direction to the 2nd respondent to take action on the petitioner's representation dated 24.3.

2017 acknowledged by the 2nd respondent on 7.4.2017 to prevent the respondents 3 and 4 from making illegal construction in Plot No.89/1 of Sy.No.809 to an extent of 200 sq.yards in Kamareddy town until the cases on the file of the Hon'ble High Court in WP.No.8084/2014 and OS.No.41/2016 on the file of the Senior Civil Judge, Kamareddy are disposed of, as illegal and arbitrary and contrary to the provisions of Municipalities Act and for a consequential direction to the 2nd respondent to take action on the petitioner's representation dated 24.3.2017 acknowledged by the 2nd respondent on 7.4.2017 to prevent the respondents 3 and 4 from making illegal construction in Plot No.89/1 of Sy.No.809 to an extent of 200 sq.yards in Kamareddi town until the cases on the file of the Hon'ble High Court in W.P.No.8084/2014 and O.S.No.

41/2016 on the file of the Senior Civil Judge, Kamareddy are disposed of."

After arguing for sometime, learned counsel for the petitioner requested the Court to direct respondent No.2 herein to consider

the representation, dated 24.03.2017, of the petitioner and pass appropriate orders in accordance with law.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, respondent No.2 is hereby directed to consider the representation, dated 24.03.2017, of the petitioner and take appropriate action in accordance with law regarding the unauthorized construction alleged to have been made by respondent Nos.3 and 4.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
