HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5095 of 2019 O R D E R :

This Criminal Petition under Section 438 of Cr.P.C. is filed by the petitioner, who is Accused, seeking anticipatory bail in Crime No.258 of 2019 of SHO, KPHB Colony Police Station, Cyberabad, Ranga Reddy District, registered for the offence punishable under Section 420 of IPC.

The case of the prosecution is that the petitioner has cheated the complainant, who is constructing a new house, by introducing himself that he is a Electrical contractor and promised the complainant that he will arrange for sanction of Electrical transformer and asked the complainant to obtain Demand Draft for Rs.1,31,257/- in the name of TSSPDCL and thereafter dodged the matter on one pretext or other and on enquiry the complainant came to know that the accused cheated him with false promise.

Heard learned counsel for the petitioner/Accused and the learned Additional Public Prosecutor appearing for the respondent State. Perused the material on record. Learned counsel for the petitioner contends that the petitioner is innocent of the alleged offence and he has not committed any offence as alleged in the complaint. It is also contended that the petitioner is ready to abide by any of the conditions imposed by this Court and would cooperate with

GSD, J Crl.P.No.5095 of 2019 the investigation, if he is released on anticipatory bail in the event of his arrest in connection with the aforesaid crime. On the other hand, the learned Additional Public Prosecutor vehemently opposed the relief sought in the above petition.

A perusal of the contents of the complaint clearly reveals that the petitioner himself approached the complainant by introducing himself as a Electrical contractor and he would arrange for sanction of Electrical transformer for his house and asked the complainant to obtain Demand Draft for Rs.1,31,257/- in the name of TSSPDCL and thereafter dodged the matter on one pretext or other. Subsequently, it is found that the orders furnished by the petitioner are all fake orders and the signatures thereon do not relate to the Department officials and that no Electrical transformers were supplied to the defacto complainant by the Department. Therefore, in view of the specific allegations made against the petitioner/Accused and keeping in view the gravity of offences alleged against him, I am not inclined to grant anticipatory bail to the petitioner/Accused. Accordingly, this Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
