THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.42919 of 2015 ORDER:
The grievance of the petitioner is as to the recovery of a One Time Penalty on the seigniorage charges payable on the used sand from its work bills.
Learned counsel appearing for the parties are agreed on the point that this issue fell for consideration before this Court in several writ petitions earlier and that no independent adjudication is called for. Copy of the order dated 16.04.2015 passed in one such writ petition, W.P.No.10657 of 2015, is placed on record.
For reasons alike as were mentioned in the afore-stated order and in terms thereof, the writ petition is disposed of directing that in case the seigniorage fee on the sand utilized by the petitioner in the works executed by it was deducted from the bills and proof thereof is filed before the Assistant Director of Mines and Geology concerned, the penalty shall not be levied.
