HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.17867 OF 2019 ORDER:

This case of the petitioner is that respondent-police illegally detained the vehicle under Registration No.TS-07-UF-9496, Maruti SwiftVDI: BSIV belongs to the petitioner under Drunken and Drive case under Sections 185(a), 130/177, 207 of M.V.Act without any jurisdiction. Hence, the present writ petition is filed seeking direction to respondents to release the subject vehicle.

Learned counsel for the petitioner submits that in similar circumstances, this Court disposed of WP.No.15643 of 2019, dated 25-07-2019. The same is not disputed by learned Assistant Government Pleader for Home.

In view of the same, for the reasons alike in the said order, this writ petition is disposed of directing the petitioner to appear before the 4th respondent with RC book relating to subject vehicle and also producing proof of his identity and thereupon the 4th respondent or other official who has the custody of the subject vehicle shall release the same to the petitioner forthwith. As a sequel, miscellaneous petitions, if any, pending shall stand closed.
