HONOURABLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN TRANSFER C.M.P. No.284 OF 2018 ORDER:

This is an application for transfer of H.M.O.P. No.32 of 2018 from the file of Principal Senior Civil Judge, Kovvur. The H.M.O.P. is filed by the husband. The petitioner in this application for transfer is the wife. She pleads that she has a six (6) year old daughter and that she has no financial support or requisite facility to go alone to contest the case in Kovvur from Hyderabad where she resides.

2. Adverting to the particulars furnished along with H.M.O.P. by the husband, it is undisputed situation that the couple has a daughter of six years old and that the wife stays in Hyderabad. On the totality of the facts and circumstances of the case, I am satisfied that there is sufficient ground to accede to the request of the petitioner.

3. Therefore, H.M.O.P. No.32 of 2018 is withdrawn from the file of Principal Senior Civil Judge, Kovvur, and transferred to the Family Court, Miyapur, Kukatpally. Accordingly, the Transfer Civil Miscellaneous Petition is allowed. No order as to costs.

As a sequel thereto, Miscellaneous Petitions, if any pending, stand closed.
