WRIT PETITION No.15509 OF 2018 ORDER :

Alleging inaction on the representation made by the petitioner to the District Collector, the Revenue Divisional Officer and the Tahsildar, this writ petition is filed.

Reading of representation dated 29.01.2018 addressed to the District Collector would disclose that original pattedar, by name, Udari Chandraiah died on 23.12.2013. After his death, his wife Smt. Udari Chandramma obtained pattadar pas books in her name. The representation would disclose that subsequently Smt.

Udari Chandramma and her three sons have agreed to give 1/3rd share of the property on payment of certain consideration and the same is not enforced.

This statement itself would disclose that insofar as the exercise undertaken by the revenue authorities under the A.P.Rights in Land and Pattadar Pass Books Act, 1971 is concerned, the same exercise has been done in the year 2014-15. Apparently, no appeal was preferred by petitioner against alleged entries made in the revenue records. Suffice to note that it cannot be said that respondent authorities erred in undertaking the earlier exercise in favour of unofficial respondents and respondent authorities cannot be faulted in not acting upon the representation made as they are not in accordance with the provisions of the Act. Petitioner has to avail remedy of appeal or revision within the limitation prescribed. Thus, leaving it open to petitioner to work out his remedies on the alleged commitment given by Smt. Udari Chandramma, writ petition is dismissed. Pending miscellaneous petitions shall stand closed. There shall be no order as to costs.
