THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 2935 of 2017 ORDER:

This writ petition is filed for the following relief: "....to issue a writ, order or direction more particularly one in the nature of 'writ of mandamus' declaring the action of the 2nd respondent in rejecting the renewal of gun licence of the petitioner vide impugned proceedings in Lr.No.C3/988/2014, dated 03.10.2015 as illegal, arbitrary and contrary to the provisions of the Arms Act and consequently directing the 2nd respondent to consider the representation of the petitioner, dated 28.03.2016 in the interest of justice....."

The application of the petitioner for renewal of gun licence was rejected by the impugned order and there is a provision for appeal against the said order.

Though the petitioner could not prefer an appeal but submitted representation, dated 28.03.2016, in view of the availability of remedy of appeal, this Court is constrained to relegate the petitioner to avail remedy of appeal within 30 days from the date of receipt of a copy of this order.
