This Criminal Petition is filed under Section 482 Cr.P.C by the petitioners/ A2 and A3, seeking to quash the proceedings in C.C.No.242 of 2004 on the file of the III Additional Judicial First Class Magistrate, Rajahmundry, where the learned Magistrate taken cognizance for the offences punishable under Sections 420, 506(2) and 323 I.P.C. which is an outcome of Crime No.76 of 2004 of III Town Police Station, Rajahmundry.
Heard learned counsel for the petitioners and learned Public Prosecutor appearing for the State, before ordering notice to respondent No.2/ de facto complainant and perused the grounds in the criminal Petition.
It is needless to say, pursuant to the summons if at all N.B.W. issued by the learned Magistrate, the petitioners are given liberty by virtue of this order to appear before the learned Magistrate concerned by filing an application under Section 70(2) Cr.P.C. for its recall, subject to execution of bonds under Section 88/ 89 Cr.P.C. for future due appearance.
