THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.3416_OF 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

The present Criminal Petition came to be filed by the petitioner/A.3 seeking release in the event of his arrest in Crime No.04 of 2016 of Medarametla Police Station, Prakasam District, registered for the offences punishable under Sections 3, 4, 5 and 6 of the Immoral Traffic (Prevention) Act, 1956.

The case of the prosecution is that on 20.01.2016 at about 8:00 P.M., police raided the house of one Shaik Syda Vali situated on Guntur Road, Opposite to Tirupal Rice Mill, Medarametla Village, where A.1 and A.2 with the support of the petitioner/A.3 running a brothel house. It is said that A.1 and A.3 were alleged to have illicit intimacy and A.3 using his position that he is working as Head Constable forcing the victims to do prostitution. The averments in the report further disclose that they are sharing the earned amount from the victims subsequently.

4. Learned counsel for the petitioner mainly submits that the petitioner is not present at the scene of offence and he was falsely implicated in this case due to some disputes in the Police Station.

5. Learned Public Prosecutor strenuously opposed the petition contending that statement of the victim clearly shows the participation of the petitioner in procuring the girls, who approach the police station for redressal of their grievances.

6. A perusal of the statement of one Sukanya speaks about the role played by A.3 in forcing the women to do prostitution and then collecting the money by blackmailing them.

7. Having regard to the nature of allegations made, I am not inclined to grant anticipatory bail to the petitioner. However, in view of the representation made by the learned counsel for the petitioner that A.1 and A.2 are already arrested and released on bail, the petitioner shall surrender before the appropriate Court and move a bail application after giving prior notice to the Public Prosecutor, in which event, the same shall be dealt with in accordance with law on the same day.
