THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.28392 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction on the part of the third respondent in disposing of the representation of the petitioner dated 17.8.2016 as illegal and arbitrary.

2. Heard Sri K.S. Murthy, learned counsel for the petitioner and Smt.A.Jayanthi, learned Government Pleader for Industries & Commerce (A.P.) and learned Standing Counsel for respondent Nos.2 and 3-Andhra Pradesh Industrial Infrastructure Corporation.

3. It is the case of the petitioner that the second respondent allotted plot No.3-A in Industrial Park, Kuppam, Chittoor District on 19.10.2011. While so, the third respondent issued notice dated 11.8.2016 directing the petitioner to hand-over vacant possession of plot No.3-A. A perusal of the record reveals that the petitioner submitted representation to the second respondent on 17.8.2016. For one reason or the other, the second respondent has not disposed of the representation of the petitioner.

At the time of the arguments, the only relief sought by the learned counsel for the petitioner is to direct the second respondent to consider the representation of the petitioner dated 17.8.2016 as early as possible. The learned Government Pleader and learned Standing Counsel for the respondent Nos.2 and 3 has also consented for disposal of the representation of the petitioner. In view of the submissions made by learned counsel for both the parties, I am inclined to dispose of the writ petition without going into the merits of the main case.

5. Accordingly, the writ petition is disposed of, directing the second respondent to consider the representation of the petitioners dated

17.8.2016 and pass appropriate orders in accordance with law, as expeditiously as possible, preferably, within a period of one month from the date of receipt of a copy of this order.
