THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37157 OF 2016 ORDER:

The writ petition is filed by the petitioners seeking a writ of mandamus declaring the action of the third respondent in interfering in civil dispute in between the petitioners and the fourth respondent and others in respect of lands admeasuring Acs.2.23 guntas in survey No.273/365 and Acs.1.09 guntas and Acs.3.32 guntas in survey No.273/366 at Pusugudem Village, Mulkalapally Mandal, Bhadradri Kothagudem District, and in calling the petitioners to the police station at the instance of the fourth respondent and others, though the petitioners have got injunction in their favour in respect of the above lands in I.A.No.202 of 2014 in O.S.No.321 of 2014 and though there is police protection order passed by the Sub Collector, Palvancha, as illegal and unlawful, and consequently to direct the third respondent not to interfere in the civil dispute between the petitioners and the fourth respondent and others. Heard and perused the material.

Learned counsel for the petitioners submits that the third respondent is interfering with the peaceful possession of the petitioners over their property, at the instance of the fourth respondent, though there is an injunction order in favour of the petitioners and as such, seeks a direction to the third respondent not to interfere with the civil disputes between the petitioners and the fourth respondent and others. Learned Assistant Government Pleader for Home (Telangana) submits that the third respondent is not interfering with the affairs of the petitioners, and more particularly the civil disputes between the petitioners and the fourth respondent.

Considering the rival submissions made by both the counsel, the writ petition is disposed of with a direction to the third respondent not to

interfere in the civil disputes between the petitioners and the fourth respondent and others. The third respondent is further directed not to call the petitioners to the police station without therebeing any case registered against them and also directed to follow the due process of law laid down in Code of Criminal Procedure.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 08.11.2016 pln
