THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36799 of 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents in calling the petitioner to the police station and threatening to file a case of adultery against the petitioner and harassing him as illegal and arbitrary.

Heard and perused the material.

Learned counsel for the petitioner submits that without therebeing any complaint against the petitioner, the respondents, more particularly, respondents 3 and 4 are frequently calling the petitioner to the police station and harassing him, as if a complaint is lodged against the petitioner by one J.Srinivas. He further submits that since a complaint is filed by one of the petitioner's colleagues against her husband, the respondents 3 and 4 are harassing and insisting the petitioner at the instigation of one J.Srinivas, to influence her colleague to withdraw the complaint lodged against her husband.

Considering the facts and circumstances of the case, the respondents 3 and 4 are directed not to interfere with the personal affairs of the petitioner and that even if any complaint is registered against the petitioners, the respondents 3 and 4 are directed to complete the investigation without arresting the petitioner and file final report, if any, in accordance with law. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 31.10.2016 pln
