Respondents Counsel for the Appellants :
Mr. J.Prabhakar Counsel for the Respondents: Mr.P.Venkata Reddy for R1 to R4 The Court made the following:
CVNR,J & TA, J Date:14.11.2018 Judgment: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This civil miscellaneous appeal is filed against order dated 22.04.2015 in I.A.No.414 of 2015 in O.S.No.35 of 2015 on the file of the Special Judge-cum-V Additional District Judge, Medak at Sangareddy.
2.
Though this appeal was filed as far back as the year 2016, no interim order has been passed in favour of the appellants. Moreover, the injunction granted by the lower court which is assailed in this appeal, is ad interim in nature, pending further orders in I.A.No.414 of 2015. Therefore, it is appropriate that the lower court disposes of the I.A. itself, at an early date.
3.
Accordingly, without interfering with the order under appeal, the lower court is directed to dispose of I.A.No.414 of 2015 on merits, after hearing both sides, within eight weeks from the date of receipt of this order.
4.
The appeal is accordingly disposed of, subject to the directions given as above.
5.
As a sequel to disposal of the writ petition, I.A.No.2 of 2016 (C.M.A.M.P.No.732 of 2016) stands disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) _____________________ (T.Amarnath Goud, J) Date: 14th November, 2018 msb
