CVNR, J & GSP, J WA.No.121 of 2016 Dt: 02.09.2016 Judgment: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Appeal is filed by the Deputy General Manager (Personnel) and the Assistant General Manager of the Andhra Bank feeling aggrieved by Order, dated 21-01-2016, in WP.No.7546 of 2004, whereby the learned Single Judge has set aside the punishment of compulsory retirement imposed on the respondent and directed his reinstatement into service with all consequential benefits.
This Writ Appeal underwent several adjournments. On the initiative of this Court, both the parties have explored the possibility of an out of Court settlement. Finally, the appellants have agreed to pay to the respondent a lumpsum amount of Rs.8 lakhs towards the full and final settlement of the latter's claim in addition to his right to receive the pension as a compulsory retiree, which is being received by him as of now. Though initially, the respondent has expected a better offer from the appellants, finally, he has given in and agreed for this proposal.
While appreciating the gesture of the appellants as well as the respondent in arriving at an out of Court settlement for giving a quietus to this vexed litigation, the Writ Appeal is
CVNR, J & GSP, J WA.No.121 of 2016 Dt: 02.09.2016 disposed of by setting aside the order of the learned Single Judge with the direction to the appellants to pay to the respondent a sum of Rs.8 lakhs within four weeks from today besides declaring the right of the respondent to continue to receive the monthly pension as a compulsory retiree. As a sequel to disposal of the Writ Appeal, WAMP.No.318 of 2016, filed by the appellants for interim relief, is disposed of as infructuous.
