HONOURABLE SRI JUSTICE P. KESHAVA RAO CRIMINAL PETITION No. 5067 of 2018 ORDER:

This criminal petition is filed under Section 482 Cr.P.C. by the petitioner/ accused seeking to set aside the docket order dated 05.12.2016 issuing N.B.W. in C.C.No.102 of 2016 on the file of the III Additional J.F.C.M. at Kakinada. The case is under Section 138 of the Negotiable Instruments Act.

Heard the learned counsel for the petitioner/ accused. Having regard to the submission of learned counsel for the petitioner, the petitioner/ accused is directed to appear before the trial Court on or before 21.05.2018 and move an application for recall of N.B.W. in which case, the trial Court shall recall N.B.W. issued against it on 5.12.2016. The N.B.W. issued by the trial Court shall be kept in abeyance.

This criminal petition is disposed of accordingly. As a sequel, miscellaneous applications pending if any, shall stand closed.
