Maila Nagaraju v. Sub Inspector
HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.40097 of 2014 ORDER:
Heard.
This writ petition is filed alleging that respondent police particularly the 5th respondent is harassing the petitioners and their family members and interfering with their personal life and liberty. The petitioners assert that no case is pending against them and they are no way concerned with the cases pending against their family members. Learned Government Pleader has received instructions, which state that various crimes are registered against one Manupati Durga Prasad and Manupati Venkateswarlu, who are brothers-in-law of the petitioners and the same are pending and that Manupati Durga Prasad and Manupati Venkateswarlu, who are accused in various crimes, are absconding. So far as the allegation of the petitioners that the 5th respondent is interfering with their personal life and liberty is concerned, the same is denied.
It is evident that even as per the instructions of the learned Government Pleader no case is registered against the petitioners. Even though there may be cases pending against the family members of the petitioners as stated above, the involvement of the petitioners prima facie has not been found. In fact, the police have also denied their interference with the personal life and liberty of the petitioners and the same is recorded. However, if the petitioners are found involved in any crime, the respondent police are at liberty to take appropriate action against the petitioners in accordance with law. Accordingly, the writ petition is disposed of. No order as to costs.
The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
