HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15378 of 2018 ORDER:

This writ petition is filed seeking the following relief :- " ......to issue a writ or order more particularly one in the nature of writ of Mandamus declaring the action of the respondent authorities in not granting the Transformer of 49 H.P., 4th respondent received the online application vide No. MIC00600159193 on 02.11.2017 as arbitrary, unjust and also against Article 21-A of the Constitution of India and constitutional direction to the respondent authorities to grant the Transformer of 49 H.P. in the premises Plot No 30, situated at Maruthinagar, Saroornagar, Karmanghat, Hyderabad ......" .

Heard Mr.Arjun Hanumanthula, learned counsel appearing for the petitioner and Sri R.Vinod Reddy, learned Standing Counsel appearing for the respondents.

It has been contended by the petitioner that it has applied for transformer vide online application on 02.11.2017 and the respondents have not installed the transformer.

In those circumstances, it has submitted a representation to the respondents seeking to install the transformer in its Industry. But, so far, no orders have been passed by the respondents in the said representation. Learned counsel appearing for the petitioner submits that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner and pass appropriate orders in accordance with law. Learned Standing Counsel appearing for the respondents contended that the respondents would consider the case of the

petitioner, in accordance with law, if it submits a fresh representation.

This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the petitioner to submit a fresh representation to the respondents within a period of two weeks from the date of receipt of a copy of this order. Upon such representation being received, the respondents shall consider the same and pass appropriate orders in accordance with law within a period of eight weeks thereafter. With the above observations, this writ petition is disposed of. No order as to costs.
