THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.27061 OF 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the action of respondent No.4 in threatening to dispossess the petitioner from the land admeasuring Acs.3.00 cents in survey No.7 situated at Velikallu Village, Dakkili Mandal, SPSR Nellore District, without issuing any notice and without following due process of law, as illegal and arbitrary.
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue for respondents. With their consent, the Writ Petition is disposed of at the stage of admission itself.
The main grievance of the petitioner in this writ petition is that without issuing any notice and without following the procedure established under law, the fourth respondent is trying to dispossess the petitioner from the subject land.
The learned AGP opposed the said submission. However, he submits that any dispossession made shall be in accordance with law.
Having regard to the above circumstances and without going into the merits of the case, the Writ Petition is disposed of directing the fourth respondent to follow due process of law, before taking any steps for dispossession of the petitioner from the land admeasuring Acs.3-00 cents in survey No.7 situated at Velikallu Village, Dakkili
Mandal, SPSR Nellore District, if the petitioner is in possession of the land.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
