THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.15322 of 2018 ORDER:
Heard learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. When the matter is taken up, a preliminary objection, as to the maintainability of the Writ Petition, is taken by the learned Government Pleader by contending that, as against the order of the District Collector, Ranga Reddy District-second respondent herein in Revision No.A7/784/C5/2016, dated 21.10.2016, revision lies to the State Government under Clause 21 (v) of the Public District System (Control Order) 2008.
It is submitted by the learned counsel for the petitioner that, though not in the form of revision, the petitioner submitted a representation to the State Government. In view of the said alternative remedy, as provided under the Control Order, this Court is not inclined to entertain the present Writ Petition. However, it is open for the petitioner herein to file revision before the State Government against the orders of the District Collector, which are impugned in the present Writ Petition and if any such revision is filed the same be considered and appropriate action be taken strictly in accordance with law.
Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
