THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.42666 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the respondent authorities in not constituting the authority under Section 51 of the Land Acquisition Act (Act 30 of 2013) and not referring the matter to the said authority as illegal, arbitrary and unconstitutional.

At the time of hearing, learned counsel for the petitioners seeks permission of this Court to permit the petitioners to withdraw the writ petition with a liberty to submit an application to the District Collector.

Permission as sought for is granted.

Hence, the Writ Petition is dismissed as withdrawn granting liberty to the petitioners to submit an application to the District Collector i.e., the second respondent. As and when the petitioners submit the application, the second respondent is hereby directed to refer the same to the competent authority constituted under Section 51 of the Act 30 of 2013. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
