THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.15467 of 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. When the matter is taken up, it is submitted by the learned Government Pleader that, as against the impugned action, there is a statutory remedy of appeal, under Section 50 of the Legal Metrology Act, 2009 and, without availing the same, the petitioner herein approached this Court by way of filing the present Writ Petition, under Article 226 of the Constitution of India.

In view of the availability of the above said alternative remedy, this Court is not inclined to entertain the present Writ Petition. However, it is open for the petitioner herein to avail the said alternative remedy of appeal, as mentioned supra, and if any such appeal is filed the same be considered and appropriate action be taken strictly in accordance with law. Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
