THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.17942 of 2019 ORDER:

This writ petition is filed seeking the following relief: " .... declaring the inaction of the respondents in considering the application dated 08.01.2019 for payment of compensation of Rs.5 lakhs as per GO Ms No.50 General Administration (Ser.A) Department dated 21.02.2014 as arbitrary and illegal and also Article 14 and 21 of Constitution of India, consequently direct the respondents to consider the application dated 08.01.2019 as per the above GO ....."

2. Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

3. Case of the petitioner is that her husband Manga Mallaiah was killed by Extremists on 29.08.1990 at Jangaon tow. Warangal District. Police registered a case in F.I.R.No.155/1990 for the offence punishable under Section 302 IPC.

4. It is submitted by the learned counsel for the petitioner that the State Government issued G.O.Ms.No.50, General Administration (SC.A) Department, dated 21.02.2014, fixing the financial assistance at Rs.5,00,000/- to the family members of those who lost their lives in the extremists violation.

5. Petitioner made representation to the third respondent on 08.01.2019 requesting to grant benefits as per G.O.Ms.No.50 dated 21.02.2014, but no action was taken thereon.

6. Taking into consideration the nature of controversy, this Court is of the considered opinion that the ends of justice would be met, if a direction is given to the third respondent to take

appropriate action on the representation, dated 08.01.2019 said to have been submitted by the petitioner herein.

7. For the aforesaid reasons, the Writ Petition is disposed of directing the third respondent to consider the representation dated 08.01.2019 said to have been submitted by the petitioner herein and pass appropriate orders thereon, within a period of two months from the date of receipt of a copy of this order, strictly in accordance with law.

Miscellaneous Petitions pending in this Writ Petition, if any, shall stand closed. No order as to costs.
