HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.791 of 2014 ORDER:
This petition is filed to withdraw O.P.No.84 of 2014 from the file of Senior Civil Judge, Sangareddy, Medak District and transfer the same to Family Court, Hyderabad for disposal in accordance with law.
2. Petitioner herein is wife and she filed her affidavit in support of petition. According to which, her marriage was performed with respondent on 25.08.2013 at Dilsukhnagar, Hyderabad. She joined respondent at Hyderabad and respondent filed O.P. before Senior Civil Judge, Sangareddy, Medak District only with a view to harass her and to obtain some ex parte orders. She stated that it is difficult for her to travel from Hyderabad to Sangareddy as she has no male assistance to accompany her. She further stated that her father is old aged person aged about 68 years suffering with Blood Pressure and Diabetes and her younger brother is prosecuting studies and he is not in a position to accompany her to Sangareddy.
She further stated that respondent is working at Hyderabad and he is also residing at Hyderabad and only with a view to harass her O.P. filed at Sangareddy, Medak District. She further stated that she has no financial support to meet travel expenses and also for defending O.P.No.84 of 2014 filed at Sangareddy. For these reasons, she prayed for transfer of O..P No.84 of 2014 from Sangareddy, Medak to Hyderabad.
3. Respondent in spite of service of notice neither appeared in person nor through any advocate.
4. Heard argument of advocate for petitioner. 5 . I have perused the material papers including affidavit of petitioner/wife. Considering the reasons stated in the affidavit and also considering the convenience of wife, I feel that the request of petitioner/wife can be considered by transferring O.P.No.84 of 2014 from Senior Civil Judge, Sangareddy to Family
Court, Hyderabad for disposal in accordance with law.
6. Accordingly, the Transfer Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
