THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.39160 OF 2012 ORDER:

The relief sought for in this Writ Petition is to declare the action of the 1st respondent in deducting an amount of Rs.1500/- p.m. from the salary of the petitioner towards penal rent without issuing any notice, and without giving him any opportunity of being heard, as arbitrary and illegal. By its order dated 28.01.2013, this Court directed interim stay of recovery of penal rent from the petitioner's salary. The petitioner's complaint, regarding collection of penal rent from him, is on the ground of violation of principles of natural justice. I consider it appropriate, therefore, to direct the respondents not to take any coercive steps for recovery of the penal rent without putting the petitioner on notice, and without giving him an opportunity of being heard. The Writ Petition stands disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed.
