THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40445 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 2nd respondent to direct respondents 3 & 4 to investigate and arresting respondents 5 & 6 on the representation, dated 17.11.2016, as illegal and arbitrary, and consequently to direct respondents 2 to 4 to investigate the Crime No.59 of 2016.
Heard and perused the material available on record. The case of the petitioner is that the petitioner lodged the present complaint against respondents 5 & 6 which was registered by respondents 3 & 4, for the offences under Sections 323, 506, 354 read with 34 IPC and Section 3(1)(x) of the SCs & STs (POA) Act, alleging that on 12.03.2016 while the petitioner was constructing the site located in front of his house, respondents 5 & 6 came to the spot and abused the petitioner by touching her caste name and also beat her with hands and legs and warned with dire consequences.
Considering the grievance of the petitioner, respondents 3 & 4 are directed to complete the investigation in Crime No.59 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
