G.P. for M.A. & U.D. for R.1 to R.3 Sri K. Ramakrishna, representing Sri K. Raghavender for R.4 THE COURT MADE THE FOLLOWING:
ORDER : (per Hon'ble Sri Justice C.V. Nagarjuna Reddy) This writ petition is filed by respondent No.5 in O.A.No.7739 of 1996 on the file of the A.P. Administrative Tribunal, Hyderabad (for brevity "the Tribunal"), feeling aggrieved by the order dated 15.12.2003 passed therein, whereby the Tribunal has directed his reversion from the post of Junior Assistant to the post of Bill Collector on the ground that he did not possess the minimum educational qualification of Intermediate in terms of G.O.Ms.No.292, dated 16.05.1992.
2.
At the hearing, there is no representation for the petitioner.
3.
perusal of the proceeding sheet shows that WPMP.No.19373 of 2004 in W.P.No.14977 of 2004 filed for interim suspension of the impugned order of the Tribunal has been dismissed.
4.
Learned counsel for respondent No.4, who is the successful applicant before the Tribunal, submitted that the impugned order of the Tribunal was given effect to by reverting the petitioner to the post of Bill Collector and that respondent No.4 was subsequently promoted. He has also submitted that as the minimum educational qualification was reduced to SSC vide G.O.Ms.No.723, dated 15.09.1997, the
petitioner was also subsequently promoted as Junior Assistant.
5.
As these submissions remained uncontroverted due to the absence of learned counsel for the petitioner, we are satisfied that the cause in the writ petition does not survive for adjudication.
6.
Accordingly, the writ petition is dismissed as infructuous.
