HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 22165 of 2003 ORDER:

This Writ Petition is filed seeking direction to direct the Respondents to pay leave encashment, D.A. arrears and PRC arrears and duty period salary, totaling to Rs.95,342/- with interest @24% to the petitioner. The counsel for the petitioner submitted that the petitioner was appointed as an LDC with the respondents during the year 1969 and the petitioner had retired from service on 31.10.2002. But the grievance of the petitioner is that the respondent was not paying leave encashment, D.A. arrears, PRC arrears and duty period salary totaling to Rs.95,342/-. To that effect, the petitioner has submitted a representation to the respondents on 18.12.2002, but so far the Respondent had not passed any orders. Therefore, the counsel for the petitioner contended that appropriate orders may be passed directing the Respondents to extend the above said benefits which he has sought for such as Leave Encashment, D.A. Arrears, PRC Arrears and duty period salary.

This Court having considered the said submissions, is of the considered view that this Writ Petition can be disposed of directing the petitioner to submit fresh representation within two weeks from the date of receipt of copy of this order and upon such representation made by the Petitioner, the Respondent shall consider and pass appropriate orders in

-2another four weeks there after.

With these observations, the Writ Petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
